PURCHASE CONDITIONS<\/h1>\n

These Purchase Conditions (herinafter referred to as \u201cConditions<\/strong>\u201d) constitute a binding contract between you and OASIS immersion<\/em> and describes your rights and obligations as a visitor of the event, as written on your Ticket(s) (hereinafter referred to as \u201cTicket<\/strong>\u201d). The French version of these \u201cConditions\u201d is also available. La version fran\u00e7aise des Conditions d\u2019achats est \u00e9galement disponible<\/u>.<\/em><\/p>\n

Your purchase of \u201cTicket(s)\u201d for the event is subject to the provisions of these present \u201cConditions\u201d, the Terms of use<\/u>, the Privacy Policy<\/u> and the Cookie Policy<\/u>, which form an integral part of the Conditions.\u00a0 If there are inconsistencies between the present \u201cConditions\u201d, and the Terms of use, the Privacy Policy or the Cookie Policy, these \u201cConditions\u201d shall prevail.<\/p>\n

The \u201cConditions\u201d are deemed to include and incorporate the Terms of use<\/u>, the Privacy Policy<\/u> and the Cookie Policy<\/u>, as they may be amended, restated, supplemented or modified by OASIS immersion<\/em> from time to time. By using this website and\/or purchasing \u201cTickets\u201d, you hereby agree to be bound by the \u201cConditions\u201d in effect at the time of purchase.<\/p>\n

TICKET PURCHASE<\/p>\n

When you purchase \u201cTicket(s)\u201d (individually a \u201cTicket\u201d and collectively \u201cTickets\u201d), you are granted a revocable license to attend the event stipulated on the \u201cTicket(s)\u201d. No other relationship between the Parties, either expressed or implied, is created by your purchase of the \u201cTicket(s)\u201d.<\/p>\n

ORDER CONFIRMATION<\/p>\n

Once your order is confirmed and your payment is completed, you will receive a confirmation and\/or email indicating a confirmation number (collectively, the \u201cOrder Confirmation<\/strong>\u201d). You must keep your confirmation number.<\/p>\n

If, for any reason whatsoever, you do not receive a confirmation number, or if you receive an error message, or encounter a service interruption, it is your sole responsibility to contact our Customer Service Representative to confirm whether or not your order has been properly processed. You are solely responsible for any problem that may occur during the purchase of your \u201cTicket(s)\u201d. In such case, OASIS immersion<\/em> shall not be responsible for any loss (monetary or otherwise) that may result from any problem occurring during the purchase of \u201cTicket(s)\u201d, including, without limitation, the failure of a transaction to be completed or confirmed, whether through the actions of OASIS immersion<\/em> and\/or its related entities, or a third party.<\/p>\n

Orders will be processed only after a billing address and other billing information have been verified. Occasionally, we receive incorrect billing or credit card account information for a ticket order. This can delay the processing of the order and the delivery of the \u201cTicket(s)\u201d. In such case, a Customer Service Representative may attempt to contact you, using the information provided at the time of purchase. If we are unable to reach you after an initial attempt, it shall reserve the right to cancel your order and sell your \u201cTicket(s)\u201d to another customer.<\/p>\n

DELIVERY<\/p>\n

The \u201cTicket(s)\u201d can either be delivered by mail at the postal address you indicated, by e-mail at the email address you indicated or, when such option is possible, by pick-up. We recommend you to select the email confirmation. If you choose to receive the \u201cTicket(s)\u201d by e-mail, you are responsible for printing your e-\u201cTicket(s)\u201d and presenting them at the event. However, print version of your e-\u201cTicket(s)\u201d is not required; e-\u201cTickets\u201d \u00a0are accepted and can be presented at the door on your mobile or electronic device. Note that certain delays and fees are applicable depending on the delivery mode you choose.<\/p>\n

SERVICE FEES<\/p>\n

Each \u201cTicket\u201d purchased is subject to a non-refundable service fee. You may be able to purchase group tickets through our Customer Service at reservations@oasis.im<\/a><\/u>.<\/p>\n

OBLIGATION TO PAY<\/p>\n

By accepting the terms of these \u201cConditions\u201d, you agree to pay the full price of the \u201cTicket(s)\u201d ordered, including any applicable taxes, delivery charges, services fees, convenience and other fees, as described in the Order Confirmation. \u201cTicket\u201d prices are in Canadian dollars.<\/p>\n

REFUNDS AND EXCHANGES<\/p>\n

You must review your \u201cTicket(s)\u201d selection before submitting your order. Subject to the provisions below for cancelled and\/or postponed events, and except as otherwise provided by any applicable law to these Conditions, there are no exchanges or refunds once the \u201cTicket(s)\u201d \u00a0have been purchased.<\/p>\n

CANCELLED AND\/OR POSTPONED EVENTS<\/p>\n

OASIS immersion<\/em> may, at its sole and entire discretion, cancel or postpone an event. When an event is cancelled or postponed, OASIS immersion<\/em> will, at its sole discretion, either offer you an exchange or a refund of your \u201cTicket(s)\u201d. OASIS immersion<\/em> will notify you in writing within a reasonable delay if an event is cancelled or postponed, at which point you will have the sole responsibility to follow the instructions and procedures provided by OASIS immersion<\/em> in order to benefit from said exchange or refund, as applicable. Please make sure to provide your order confirmation number provided on the Order Confirmation at the time of your inquiry to facilitate the exchange or refund process, as applicable.<\/p>\n

As a general rule, if an event is cancelled and no postponement date is offered, the credit card with which you purchased the \u201cTicket(s)\u201d will be credited and you will be refunded. However, OASIS immersion<\/em> reserves the right to decide on an alternative refund or exchange method for a particular event.<\/p>\n

OASIS immersion<\/em> may change its refund and\/or exchange policies at any time, at its sole and entire discretion.<\/p>\n

EARLY OR LATE ARRIVALS<\/p>\n

Your event begins at a precise time, as written on your \u201cTicket(s)\u201d. Early comers or latecomers may be admitted only at an appropriate time, at the sole discretion of the ushers or other employees of OASIS immersion<\/em>.<\/p>\n

RIGHT TO CANCEL TICKETS, REFUSE ACCESS AND EXPEL<\/p>\n

OASIS immersion<\/em> reserves the right to cancel any \u201cTicket(s)\u201d or order of \u201cTicket(s)\u201d and to institute legal proceedings against you, should you breach any provision of these \u201cConditions\u201d or this website.<\/p>\n

OASIS immersion<\/em> reserves the right to request a photo ID of the \u201cTicket(s)\u201d holder. In the event any person attending an event is judged unmanageable or exhibits behaviour which is considered inappropriate, or fails to comply with OASIS immersion<\/em> rules, OASIS immersion<\/em> reserves the right to terminate such person’s license to attend the event and immediately expel such person, without any refund or compensation.<\/p>\n

The \u201cTicket(s)\u201d purchased are revocable licenses and admission to a \u201cTicket\u201d holder may be refused for any reason (or no reason) at the sole and entire discretion of OASIS immersion<\/em>, its employees, agents, officers or representatives, upon refunding the \u201cTicket\u2019s\u201d face value. \u201cTicket(s)\u201d shall not be redeemable for cash.<\/p>\n

RECORDING, TRANSMISSION AND PUBLICATION<\/p>\n

The use of all photo cameras and video recorders (including those integrated in cell phones or other mobile or electronic devices) is strictly forbidden on the site of the event. Nevertheless, you are authorized to take photographs and short clips, provided you do not use a flash and that your photographs\/short clips are distributed solely for personal use.<\/p>\n

By purchasing your \u201cTicket(s)\u201d, you hereby grant OASIS immersion<\/em> the right to use your image, likeness, actions and statements in any transmission, publication or reproduction of the event in any means or circumstances, without any further permission or compensation.<\/p>\n

PROGRAM CHANGES<\/p>\n

OASIS immersion<\/em> reserves the right to make any changes in the content and the duration of the event. Moreover, the duration of the event may differ from time to time.<\/p>\n

NO RESALE<\/p>\n

The resale of \u201cTicket(s)\u201d is strictly prohibited. OASIS immersion<\/em> reserves the right to cancel the license granted under the \u201cTicket(s)\u201d in connection with any fraudulent sale of such \u201cTicket(s)\u201d, without refund or other compensation.<\/p>\n

NO PROMOTION WITHOUT PERMISSION<\/p>\n

The \u201cTicket(s)\u201d may not be used for any advertising and\/or promotional purposes, including as giveaways for contests and sweepstakes, or resold for the purposes of same without the prior written authorization of OASIS immersion<\/em>.<\/p>\n

USE OF PERSONAL INFORMATION<\/p>\n

In addition to and without limiting the generality of the provisions set forth in our Privacy Policy<\/u>, by purchasing \u201cTicket(s)\u201d, you expressly agree that the personal information you provide us may be used by OASIS immersion<\/em> or its affiliates, or other persons acting on behalf of OASIS immersion<\/em>, in order to deliver the \u201cTicket(s)\u201d to you and add you to our distribution list in order to send you offers and other promotional or marketing activities to you and to provide you with the latest information about OASIS immersion<\/em> and its events. If you would rather that we not continue to use your personal information, please contact us at bonjour@oasis.im<\/a><\/u>.<\/p>\n

LIMITATION OF LIABILITY<\/p>\n

Under no circumstances shall OASIS immersion<\/em> or any of its employees, directors, officers, administrators, agents, affiliates or other related entities, sponsors, distributors, vendors, suppliers, representatives, partners and all other persons acting on behalf of OASIS immersion<\/em>, be liable for any direct, indirect, incidental, special or consequential damages resulting from the use of or the inability to use the website or for the cost of procurement of substitute services, tickets or other products or resulting from any services, tickets or other products purchased or obtained or messages received or transactions entered into through the website or resulting from unauthorized access to or alteration of your transmissions of data, including, but not limited to, damages for loss of profits, use of data or other intangibles, even if OASIS immersion<\/em> has been advised of the possibility of such damages.<\/p>\n

If you are dissatisfied with this website or any content on the website, or the service, or with these conditions, your sole and exclusive option is to discontinue the use of this website.<\/p>\n

Notwithstanding all security measures in place on the site, injury or infection to diseases may occur during the event. By accepting the terms of these \u00ab Conditions \u00bb, you assume all risk, liability and responsibility for any and all damages of any nature suffered by you, including, without limitation, bodily harm and loss of property incurred during or in connection with the event. Furthermore, you hereby waive any and all rights to claim damages or to institute civil, criminal, administrative or legal proceedings against Oasis immersion<\/em>, its affiliates and other related entities or their directors, officers, administrators, agents, employees, sponsors, distributors, vendors, suppliers, representatives, partners and all other persons acting on behalf of oasis immersion, resulting from any cause whatsoever arising either before, during or after the event.<\/p>\n

All claims or causes of action arising from or related to your purchase of \u201cTicket(s)\u201d, the use of the Oasis immersion<\/em> website or its terms and conditions must be filed within one (1) year following the date on which such claim or cause of action first arose.<\/p>\n

In certain cases, applicable laws may not allow the limitation of liability set forth above, so this limitation of liability may not apply in such particular cases. If any part of this limitation of liability is found to be invalid or unenforceable for any reason, then Oasis immersion<\/em>\u2019s aggregate liability (and that of our employees, directors, officers, administrators, agents, affiliates or other related entities, distributors, vendors, suppliers, partners, sponsors, representatives or all other persons acting on behalf of Oasis immersion<\/em>) under such circumstances for liabilities that otherwise would have been limited shall not exceed the purchase price of the tickets detailed in the order confirmation page.<\/p>\n

INDEMNIFICATION<\/p>\n

You hereby agree to indemnify and hold harmless OASIS immersion<\/em>, its affiliates and other related entities, their directors, officers, administrators, managers, employees, representatives and all other persons acting on behalf of OASIS immersion<\/em> from and against any and all claims, actions, damages or other demands, including, but not limited to, reasonable costs and expenses of litigation, such as counsel fees, arising from or relating to your purchase of \u201cTicket(s)\u201d or your use of OASIS immersion<\/em>\u2019s website or of the Service.<\/p>\n

ASSIGNMENT<\/p>\n

OASIS immersion<\/em> may at any time assign all or part of its rights and obligations under these \u201cConditions\u201d provided that the assignee assumes all of OASIS<\/em> immersion<\/em>\u2019s obligations hereunder.<\/p>\n

INVALIDITY<\/p>\n

If any term, provision or section of these \u201cConditions\u201d or any portion of such term, provision or section is held invalid or unenforceable, or in the event that a court of competent jurisdiction declares a portion of these \u201cConditions\u201d invalid or unenforceable, the remainder of these \u201cConditions\u201d will not be affected thereby and each remaining term, provision or section, or portion thereof, will be valid and enforceable to the full extent permitted by law.<\/p>\n

APPLICABLE LAWS AND EXCLUSIVE JURISDICTION<\/p>\n

The Parties hereby agree that these \u201cConditions\u201d shall be governed by and interpreted according to the laws applicable within the Province of Qu\u00e9bec and the laws of Canada applicable therein, without regard to conflict of law provisions. Furthermore, the Parties hereby elect to submit to the exclusive jurisdiction of the Courts of the Province of Qu\u00e9bec, in the Judicial District of Montr\u00e9al, in respect of any action or proceeding arising out of or related to these \u201cConditions\u201d. However, the foregoing clause is in force without prejudice to the rights of OASIS immersion<\/em> to obtain any protective proceeding such as an injunction from any competent court having jurisdiction.<\/p>\n

TICKET CONDITIONS<\/p>\n

The following paragraph applies to all \u201cTicket\u201d \u00a0holders and such text appears on all printed \u201cTicket(s)\u201d \u00a0and forms an integral part of these \u201cConditions\u201d:<\/p>\n

IMPORTANT<\/strong> – No exchange and no refund. Upon cancellation of an event for which no postponement date is foreseen, this ticket may be refunded pursuant to the \u201cConditions\u201d set forth by OASIS immersion<\/em> (\u201cOASIS immersion<\/em><\/strong>\u201d). No refund of service fees. Any falsification or resale of \u201cTickets\u201d is prohibited. This \u201cTicket\u201d is void following a sworn complaint of theft thereof to the local police station. This \u201cTicket\u201d \u00a0\u00a0grants the right to its holder to assist at the event and grants no other right. This \u201cTicket\u201d may not be used for advertising, promotion, including contests and sweepstakes, or other commercial purposes without the prior written consent of OASIS immersion<\/em>. The holder of this \u201cTicket\u201d assumes any and all liabilities as to the risks and dangers that may result from this event and renounces any claim for loss or damage whatever the cause, incurred or suffered by the holder, whether occurring before, during or after the event. The holder of this \u201cTicket\u201d renounces to any claim resulting from the capture or transmission of his\/her image while on the premises where the event takes place. The use of this \u201cTicket\u201d is subject to the rules in force on the premises where the event takes place. You must comply with the rules established by OASIS immersion<\/em>. Management reserves the right to refuse access to the event or to evict any person whose behaviour shall be deemed inadequate. Expulsion cancels this ticket and the holder there upon forfeits all claims, including any claim to a refund of their ticket price. The holder of this ticket may be frisked at the entrance of certain events. Holder consents to a reasonable examination of his\/her person and effects to ensure compliance. It is strictly prohibited to carry weapons. It is strictly prohibited and to enter the site with alcoholic beverages and to bring any type of food or beverage inside the event premises. It is also strictly prohibited to bring any large items (bags, packsacks, suitcases, etc.). Smoking and vaping are strictly prohibited on the premises where the event takes place. The use of tape recorders and camcorders is also prohibited, but photographs may be taken without flash for personal use only. This \u201cTicket\u201d or the rights represented hereby or arising herefrom may not be assigned, sold or transferred commercially or as part of a promotion, with or without consideration, without the express written consent of OASIS immersion<\/em>.<\/p>\n

GENERAL<\/p>\n

The headings in these \u201cConditions\u201d are provided for clarity only and do not form an integral part of these \u201cConditions\u201d. If you read these \u201cConditions\u201d in English, the Parties agree that these \u201cConditions\u201d shall be drawn up in the English language.
